PD opened the hearing.

Variance Request

PD read a request from the applicant to withdraw without prejudice.
JD motion to allow to withdraw.

All in favor to allow the applicant to withdraw.

New – 1040 South Main Street – Omar Wenger

The applicant, Mr. Wenger was in attendance requesting a permit to be allowed to breed Yorkshire Terrier puppies, possibly 8, on his property where he lives and operates a farm and business. He has met with the Animal Control Officer.  Tracey Taddeo, Animal Control Officer was in attendance.  She stated she did visit the site, spoke with the owner.  He currently has a heated indoor area.  She feels that 8 adult breeders will be acceptable but would like to suggest an outdoor area for the dogs to run in. Mr. Wenger’s closest abutter is 300 feet across the street and he is 150’ off the road himself.  He did supply a site map of the property.  He will be breeding and not boarding.  The puppies must be sold before 6 months olds. The waste will be used in the fields as fertilizer.  He has a caretaker if he happens to be away.  Mike Connors, 13 Bellstone Drive inquired about advertising the pups as he felt there were already many signs on the property.  Mr. Wenger stated they put a sign up and advertise in the newspaper when the puppies are ready. He stated he would comply with any zoning regulations in regards to signage.  He stated he was also aware of the fees due to the clerk for kennels.

JS motion to grant a special permit to allow for an animal kennel for breeding purposes, with a maximum of 8 adult dogs (6 months or older) and to provide and outdoor kennel run, meeting all zoning requirements for structures and signage in that area.
AP second.
All in favor to grant the Special Permit.

There is a 20 day appeal period.

Appeal of the Building Inspector Decision of a foundation & Building Permit

PD read a letter dated 3/6/14 from the applicants’ attorney to withdraw their applications (foundation and building permits).

JS motion to accept the withdrawal as requested.
JD second.
All in favor to allow the applicants to withdrew their requests.

PD read a letter from Mrs. Chimeno seeking a continuance due to a medical situation with her husband.

Request for a variance

PD read an email sent to Laura by the applicant seeking to continue to April 3, 2014 as they needed more time to gather information.

Discussion – Taft Estates 40B Project – 579 Pulaski Blvd.

Mr. Jones was in attendance to discuss applying for Building Permits for his 40B project.  JS stated he needed to formalize this request and forward it to Jay Talerman, Town Counsel.  The board needs to know exactly what will be requested.  This is an informal setting and nothing can be voted on.  Mr. Jones agreed to put a letter together for Town Counsel.  

Other Business:
JS read a letter from Jay Talerman, Town Counsel regarding the 870 South Main Street hearing for a Special Permit. It has been determined that the applicants will need to apply for a Variance instead of the current special permit. Jay Talerman would let their attorney know this.
